Guest Column: Texas Should Leave Redistricting Alone

Redistricting fights are a lot like cicadas ? they emerge every 10 years. They?re ugly and loud and get lots of attention. Then they go away.

Here in Texas, the redistricting fight is not going away.

Republican state and legislative leaders in Texas have taken redistricting far beyond a loud, ugly fight between Republicans and Democrats. They have turned it into an attack on racial fairness that involves the U.S. Department of Justice, two federal district courts and the U.S. Supreme Court.

Eight months ago, a three-judge federal court ? including two judges appointed by Republican presidents ? said it straight up, unanimously ruling on the redistricting maps submitted by Attorney General Greg Abbott that were passed by the GOP-led Legislature and signed by Gov. Rick Perry in 2011.

The judges said that the Texas maps were designed to discriminate ? that the maps showed ?more evidence of discriminatory intent than we have space, or need to address here.?

Sadly, Texas is all alone ? the only state in the country ? that couldn?t pass the most basic legal test for fairness.

All of the other southern states covered under the Voting Rights Act ? Alabama, Georgia, Louisiana, Mississippi, Georgia and Virginia ? were able to adopt district maps that did not discriminate against their minority citizens.

Rather than accept the ruling of the court and work to draw fair districts that reflect the racial makeup of Texas, Abbott, Perry, Lt. Gov. David Dewhurst and House Speaker Joe Straus have spent millions of Texas taxpayer dollars fighting to impose discriminatory boundaries on Texans.

Just last week, state Senate Republicans again demonstrated why Texans have no reason to trust the intentions of GOP leaders when it comes to fair district boundaries.

The senators gave barely 48 hours' notice for a public hearing on redistricting to consider maps they know members who represent Latino and African-American districts oppose. Of course, the leadership had no real interest in hearing from the public or giving anyone the chance to provide meaningful comment.

They simply intend to impose their will.

Even as the hearing proceeded, Abbott ? on behalf of the state ? has arguments pending in the U.S. Supreme Court demanding that the 2011 maps that the district court ruled discriminatory be imposed on Texas.

Going even further, Abbott is also arguing to repeal key provisions of the U.S. Voting Rights that protect against exactly the type of discrimination practiced by Texas GOP leaders.

Ultimately, it is almost certain that the courts will determine Texas district boundaries. Certainly, no one should expect a series of spirited redistricting debates in the Legislature with respectful back-and-forth negotiations and final agreement around maps that reflect fairness and common ground. GOP state leaders have shown no interest in that approach. Moreover, they have forfeited the basic trust such an approach requires.

The approach to redistricting chosen by those leaders exposes a dark and damning calculation. They have decided that as the Latino and African-American populations in our state grow, they would rather weaken and undermine minority voting strength than make fair and reasonable policy choices designed to win the support of Latino or African-American voters.

It's an approach that flies in the face of everything that so many Texans have fought and died for ? the right to vote, the right to choose our own leaders, the right to be part of laying the course for our shared future.

As Texans we see ourselves ? rightly ? as forward-looking and fair. Our state leaders let all of us down when they design redistricting plans that aren?t remotely fair or equitable and that discriminate against our citizens.

Texas is a better place than this.

Texans are better people than this.

It?s time we acknowledged that this latest fight over the right to vote is not about politics or minorities at all.

It?s about morality.

The event featured a nasty broken thumb on Yancy Medeiros, and equally nasty broken toe on Jon Jones, two fight stoppages because of eyepokes, and one fight that was canceled hours before it was supposed to happen.

But the craziest part of all? The demonic voice that was heard between rounds of Michael Bisping's win over Alan Belcher.

Did the gates of hell open before the fight, and did Satan send his minions to New Jersey? Were Bisping's cornermen, who were bathed in creepy red light, actually demons? Middle Easy thinks it was a spell from "Passages of the Dead."

It's possible the UFC ticked off the wrong person and got the evil eye thrown its way. The bigger question: Are we all cursed for watching the bouts?

Cyprus to limit president's immunity from prosecution

NICOSIA (Reuters) - Cyprus plans to limit presidential immunity from prosecution and increase government transparency, its president said on Monday, a move to win over a public jaded by graft and economic mismanagement that saddled it with brutal bailout terms.

Cypriots have been left in shock by a series of events which tipped the euro zone's third smallest economy into a chaotic bailout last month, with bank savings raided and the island's second-largest bank forced to shut down.

In power for little over two months, President Nicos Anastasiades unveiled significant changes he said would boost public confidence and modernize the function of the state on the eastern Mediterranean island.

They included changes to the constitution to broaden the offences under which a president could be prosecuted, limiting an incumbent's term in office to two consecutive terms, lifting immunity on lawmakers and forcing those who hold important state or political positions to submit income statements.

"The public justifiably criticizes politicians that they aren't honest with people and forget their promises as soon as they are elected. Today I want to contradict that rule," Anastasiades said in a public address.

Anastasiades has encouraged Supreme Court judges to give his own affairs special attention in an investigation now under way into almost a decade of financial profligacy and malfeasance that finally laid Cyprus low last month.

Public resentment of perceived high-level corruption and privilege rose further when bank transactions were leaked showing that a firm owned by relatives of Anastasiades was among hundreds that shifted millions out of one bank before the island's financial system was locked down on March 16.

Anastasiades has not commented on that case but his in-laws denied any wrongdoing in what they called normal business transactions.

A report by anti-graft watchdog Transparency International last week said 91 percent of Cypriot respondents believed graft was a big problem in the country. Some 79 percent believed it would get worse because of the financial crisis.

Anastasiades's center-right government, which won elections in February, commissioned a judicial inquiry to look into causes of the crisis, which was triggered in part by massive holdings of Greek sovereign debt by Cypriot banks.

Anastasiades said any recommendations by judicial commissions would be binding.

At present, Cyprus's constitution offers presidents immunity from prosecution. That protection is only removed for high treason or moral turpitude.

Attempts to strip the immunity of former president Demetris Christofias were blocked by the Supreme Court last year.

Families of 13 victims of a massive munitions explosion which destroyed Cyprus's largest power station in mid-2012 sought to have Christofias's immunity lifted, holding him morally responsible for the disaster.

A state-appointed board of inquiry had reached the same conclusions on Christofias's role.

Stocks up in midday trading as spending rises

NEW YORK (AP) ? Technology companies led the stock market higher Monday, pushing the Standard & Poor's 500 index back up to the record high it reached earlier this month.

A pair of strong economic reports also encouraged investors. Wages and spending rose in the U.S. last month, and pending home sales hit their highest level in three years.

Shortly after 12 p.m., the Dow Jones industrial average was up 85 points at 14,798, a gain of 0.6 percent. Microsoft and IBM were among the Dow's best performers, rising 2 percent each.

Big tech firms have slumped this month. Concerns about weak business spending and slower overseas sales have weighed on the industry, said Marty Leclerc, the managing partner of Barrack Yard Advisors, an investment firm in Bryn Mawr, Pa. Revenue misses from IBM and other big tech companies have highlighted the industry's vulnerability to the world economy.

"The areas of the stock market that haven't done as well rely on exports," Leclerc said. "Those stocks more dependent on the domestic economy have done the best."

Tech played catch-up on Monday. Information technology stocks rose the most of the 10 industry groups in the S&P, 1.5 percent. It's the only group that remains lower over the past year.

The S&P 500 index was up 11 points to 1,593, a gain of 0.7 percent. That matches its all-time closing high reached on April 11.

The Nasdaq composite rose 32 points at 3,311, a rise of 1 percent. Apple, the biggest stock in the index, rose 3.5 percent to $431.95.

The number of Americans who signed contracts to buy homes reached the highest level since April 2010, according to the National Association of Realtors. Back then, a tax credit for buying houses had lifted sales. Separately, the government reported that Americans' spending and income both edged up last month.

Moody's and Standard & Poor's parent company McGraw-Hill surged following news that the ratings agencies settled lawsuits dating back to the financial crisis that accused them of concealing risky investments. McGraw-Hill gained 6 percent to $54.80, while Moody's jumped 10 percent to $61.02, the biggest gain in the S&P 500.

Eaton Corp. gained 5 percent to $61.31 after reporting that its quarterly net income jumped, beating Wall Street's estimates. The results were helped by its acquisition of Cooper Industries, an electrical equipment supplier.

In the market for government bonds, the yield on the 10-year Treasury note slipped to 1.65 percent. That's down from 1.67 percent late Friday.

Daily Chronicle | Are lesbians more accepted than gay men?

CHICAGO ? It may be a man?s world, as the saying goes, but lesbians seem to have an easier time living in it than gay men do.

High-profile lesbian athletes have come out while still playing their sports, but not a single gay male athlete in major U.S. professional sports has done the same. While television?s most prominent same-sex parents are the two fictional dads on ?Modern Family,? surveys show that society is actually more comfortable with the idea of lesbians parenting children.

And then there is the ongoing debate over the Boy Scouts of America proposal to ease their ban on gay leaders and scouts.

Reaction to the proposal, which the BSA?s National Council will take up next month, has been swift and often harsh. Yet amid the discussions, the Girl Scouts of USA reiterated their policy prohibiting discrimination based on sexual orientation, among other things. That announcement has gone largely unnoticed.

Certainly, the difference in the public?s reaction to the scouting organizations can be attributed, in part, to their varied histories, including the Boy Scouts? longstanding religious ties and a base that has become less urban over the years, compared with the Girl Scouts?.

But there?s also an undercurrent here, one that?s often present in debates related to homosexuality, whether over the military?s now-defunct ?Don?t Ask, Don?t Tell? policy or even same-sex marriage. Even as society has become more accepting of homosexuality overall, longstanding research has shown more societal tolerance for lesbians than gay men, and that gay men are significantly more likely to be targets of violence.

That research also has found that it?s often straight men who have the most difficult time with homosexuality ? and particularly gay men ? says researcher Gregory Herek.

?Men are raised to think they have to prove their masculinity, and one big part about being masculine is being heterosexual. So we see that harassment, jokes, negative statements and violence are often ways that even younger men try to prove their heterosexuality,? says Herek, a psychologist at the University of California, Davis, who has, for years, studied this phenomenon and how it plays out in the gay community.

That is not, of course, to downplay the harassment lesbians face. It can be just as ugly.

But it?s not as frequent, Herek and others have found, especially in adulthood. It?s also not uncommon for lesbians to encounter straight men who have a fascination with them.

?The men hit on me. The women hit on me. But I never feel like I?m in any immediate danger,? says Sarah Toce, the 29-year-old editor of The Seattle Lesbian and managing editor of The Contributor, both online news magazines. ?If I were a gay man, I might ? and if it?s like this in Seattle, can you imagine what it is like in less-accepting parts of middle America??

One of Herek?s studies found that, overall, 38 percent of gay men said that, in adulthood, they?d been victims of vandalism, theft or violence ? hit, beaten or sexually assaulted ? because they were perceived as gay. About 13 percent of lesbians said the same.

A separate study of young people in England also found that, in their teens, gay boys and lesbians were almost twice as likely to be bullied as their straight peers. By young adulthood, it was about the same for lesbians and straight girls. But in this study, published recently in the journal Pediatrics, gay young men were almost four times more likely than their straight peers to be bullied.

At least one historian says it wasn?t always that way for either men or women, whose ?expressions of love? with friends of the same gender were seen as a norm ? even idealized ? in the 19th century.

?These relationships offered ample opportunity for those who would have wanted to act on it physically, even if most did not,? says Thomas Foster, associate professor and head of the history department at DePaul University in Chicago.

Today?s ?code of male gendered behavior,? he says, often rejects these kinds of expressions between men.

We joke about the ?bro-mance? ? a term used to describe close friendships between straight men. But in some sense, the humor stems from the insinuation that those relationships could be romantic, though everyone assumes they aren?t.

Call those friends ?gay,? a word that?s still commonly used as an insult, and that?s quite another thing. Consider the furor over Rutgers University men?s basketball coach Mike Rice, who was recently fired for mistreating his players and mocking them with gay slurs.

If two women dance together at a club or walk arm-in-arm down the street, people are usually less likely to question it ? though some wonder if that has more to do with a lack of awareness than acceptance.

?Lesbians are so invisible in our society. And so I think the hatred is more invisible,? says Laura Grimes, a licensed clinical social worker in Chicago whose counseling practice caters to gay, lesbian, bisexual and transgender clients.

Grimes says she also frequently hears from lesbians who are harassed for ?looking like dykes,? meaning that people are less accepting if they look more masculine.

Still, Ian O?Brien, a gay man in Washington, D.C., sees more room for women ?to transcend what femininity looks like, or at least negotiate that space a little bit more.?

O?Brien, who?s 23, recently wrote an opinion piece tied to the Boy Scout debate and his own experience in the Scouts when he was growing up in the San Diego area.

?To put it simply: Being a boy is supposed to look one way, and you get punished when it doesn?t,? O?Brien wrote in the piece, which appeared in The Advocate, a national magazine for the gay, lesbian, bisexual and transgender communities.

Joey Carrillo, a gay student at Elmhurst College in suburban Chicago, remembers trying to be as masculine as possible in high school. He hid the fact that he was gay, particularly around other athletes. As a wrestler, he says he never wanted to hear someone say, ?Oh, THAT?S why he wrestles.?

In fact, though more gay and lesbian athletes are coming out in college, gay male professional athletes in major sports have waited to do so until they have left their sport, one of the more recent being Robbie Rogers, an American soccer player who played professionally in England. There have been reports that gay male athletes who are currently playing may be on the verge of going public.

But women have already done so with little backlash.

U.S. soccer star Megan Rapinoe, for instance, came out right before she played in last year?s Olympics. WNBA star Seimone Augustus and the league?s No. 1 draft pick, Brittney Griner, are some of the more recent female athletes to follow suit.

In Hollywood in recent years, both openly gay men and lesbians have had successful careers. And when it comes to television and movies, it appears there are more high-profile gay male characters.

Still, while many see the two dads on the ?Modern Family? sitcom as groundbreaking, others have a sense that the societal discomfort with gay men as parents is at the root of many of the jokes.

?A good portion of that is for comedic effect,? says Don Todd, a 32-year-old father in a two-dad family in Orange, Calif. He doesn?t think most people would think it was as funny if the characters were two moms.

Herek, the researcher at UC-Davis, has, in fact, found in surveys that heterosexuals think lesbians would be better parents than gay men.

Nancy Dreyer, a mother in a two-mom family, has noticed this in her own life.

?With gay male friends of ours who have kids, people will say, ?My gosh, who takes care of this baby?? ? as if they?re not capable,? says Dreyer, whose 57 and lives in suburban Boston.

The assumption, she says, is that men aren?t nurturing. And if they?re too nurturing, she says, people get suspicious, noting that no one has ever questioned her and her partner about their ability to raise their son, who?s now in college.

She?s noticed the different ways society treats gay men and lesbians, partly because she has a brother, Benjamin Dreyer, who?s gay. The Dreyer siblings say it?s difficult to compare their experiences because Benjamin came out in college, and Nancy in her early 30s.

So he was the first to tell their parents. ?They yelled at me. They took you to dinner,? Benjamin Dreyer, who?s 54 and works in publishing in New York City, now jokes with his sister.

Truth was, as a young gay man coming of age as the AIDS epidemic took hold, his parents simply worried, and with good reason, his sister says.

There?s little doubt, they both say, that AIDS influenced the perception of gay men.

Benjamin Dreyer says he dealt with societal bias by avoiding it, and surrounding himself with people he knew would be supportive, including his parents, eventually.

But he?s also realizing how quickly the need to do that is disappearing. He was surprised and pleased, for instance, when he attended his nephew?s high school graduation last year. There, he saw a gay male graduate with his boyfriend, open and accepted by all his peers.

?It?s mind-boggling,? Benjamin Dreyer says. ?It?s wonderful.?

Carrillo, too, decided to live openly when he arrived at Elmhurst College. He joined a fraternity and even painted a rainbow ? a common symbol of the gay community ? on his fraternity paddle. To his surprise, there was some backlash from a couple of his straight fraternity brothers who feared people would think their fraternity was the ?gay fraternity.?

?There?s a long way to go,? says Carrillo, who graduates next month. But he still feels hopeful.

?Honestly, I see it ? everywhere there?s progress.?

Bosnian president arrested in corruption crackdown

SARAJEVO, Bosnia-Herzegovina (AP) ? Bosnian police on Friday arrested one of the country's presidents along with 18 other people as part of a corruption investigation in one of the country's two main sections, a spokesman for the prosecution said.

The nation of Bosnia-Herzegovina consists of the Serb-run Republika Srpska and the Bosniak-Croat Federation. Both are highly independent, and each has its own president, government and parliament.

Zivko Budimir, a president of the Bosniak-Croat Federation, the president of the region's commission of pardons Hidajet Halilovic, and at least 17 other officials were arrested on Friday.

A spokesman for the Bosnian prosecutor's office, Boris Grubesic, confirmed the arrests. He said members of the group were suspected of "abuse of office, illegal intermediation, receiving and giving bribes, organized crime and drug trafficking."

He made clear that not all members of the group were suspected of all of the crimes.

Police had earlier searched Budimir's presidential office and several other government buildings.

Bosnia is one of the world's most over-governed countries and has four more presidents ? one for the Serb-run region and a three-person presidency linking the country's two parts.

It is considered one of the most corruption-prone countries in Europe, partly due to the complex administrative framework but also because of the deep ethnic and political divisions remaining since the country's 1992-95 war.

'Taxels' convert mechanical motion to electronic signals

Using bundles of vertical zinc oxide nanowires, researchers have fabricated arrays of piezotronic transistors capable of converting mechanical motion directly into electronic controlling signals. The arrays could help give robots a more adaptive sense of touch, provide better security in handwritten signatures and offer new ways for humans to interact with electronic devices.

The arrays include more than 8,000 functioning piezotronic transistors, each of which can independently produce an electronic controlling signal when placed under mechanical strain. These touch-sensitive transistors -- dubbed "taxels" -- could provide significant improvements in resolution, sensitivity and active/adaptive operations compared to existing techniques for tactile sensing. Their sensitivity is comparable to that of a human fingertip.

The vertically-aligned taxels operate with two-terminal transistors. Instead of a third gate terminal used by conventional transistors to control the flow of current passing through them, taxels control the current with a technique called "strain-gating." Strain-gating based on the piezotronic effect uses the electrical charges generated at the Schottky contact interface by the piezoelectric effect when the nanowires are placed under strain by the application of mechanical force.

The research will be reported on April 25 in the journal Science online, at the Science Express website, and will be published in a later version of the print journal Science. The research has been sponsored by the Defense Advanced Research Projects Agency (DARPA), the National Science Foundation (NSF), the U.S. Air Force (USAF), the U.S. Department of Energy (DOE) and the Knowledge Innovation Program of the Chinese Academy of Sciences.

"Any mechanical motion, such as the movement of arms or the fingers of a robot, could be translated to control signals," explained Zhong Lin Wang, a Regents' professor and Hightower Chair in the School of Materials Science and Engineering at the Georgia Institute of Technology. "This could make artificial skin smarter and more like the human skin. It would allow the skin to feel activity on the surface."

Mimicking the sense of touch electronically has been challenging, and is now done by measuring changes in resistance prompted by mechanical touch. The devices developed by the Georgia Tech researchers rely on a different physical phenomenon -- tiny polarization charges formed when piezoelectric materials such as zinc oxide are moved or placed under strain. In the piezotronic transistors, the piezoelectric charges control the flow of current through the wires just as gate voltages do in conventional three-terminal transistors.

The technique only works in materials that have both piezoelectric and semiconducting properties. These properties are seen in nanowires and thin films created from the wurtzite and zinc blend families of materials, which includes zinc oxide, gallium nitride and cadmium sulfide.

In their laboratory, Wang and his co-authors -- postdoctoral fellow Wenzhuo Wu and graduate research assistant Xiaonan Wen -- fabricated arrays of 92 by 92 transistors. The researchers used a chemical growth technique at approximately 85 to 90 degrees Celsius, which allowed them to fabricate arrays of strain-gated vertical piezotronic transistors on substrates that are suitable for microelectronics applications. The transistors are made up of bundles of approximately 1,500 individual nanowires, each nanowire between 500 and 600 nanometers in diameter.

In the array devices, the active strain-gated vertical piezotronic transistors are sandwiched between top and bottom electrodes made of indium tin oxide aligned in orthogonal cross-bar configurations. A thin layer of gold is deposited between the top and bottom surfaces of the zinc oxide nanowires and the top and bottom electrodes, forming Schottky contacts. A thin layer of the polymer Parylene is then coated onto the device as a moisture and corrosion barrier.

The array density is 234 pixels per inch, the resolution is better than 100 microns, and the sensors are capable of detecting pressure changes as low as 10 kilopascals -- resolution comparable to that of the human skin, Wang said. The Georgia Tech researchers fabricated several hundred of the arrays during a research project that lasted nearly three years. The arrays are transparent, which could allow them to be used on touch-pads or other devices for fingerprinting. They are also flexible and foldable, expanding the range of potential uses.

Among the potential applications:

? Multidimensional signature recording, in which not only the graphics of the signature would be included, but also the pressure exerted at each location during the creation of the signature, and the speed at which the signature is created.

? Shape-adaptive sensing in which a change in the shape of the device is measured. This would be useful in applications such as artificial/prosthetic skin, smart biomedical treatments and intelligent robotics in which the arrays would sense what was in contact with them.

? Active tactile sensing in which the physiological operations of mechanoreceptors of biological entities such as hair follicles or the hairs in the cochlea are emulated. Because the arrays would be used in real-world applications, the researchers evaluated their durability. The devices still operated after 24 hours immersed in both saline and distilled water.

Future work will include producing the taxel arrays from single nanowires instead of bundles, and integrating the arrays onto CMOS silicon devices. Using single wires could improve the sensitivity of the arrays by at least three orders of magnitude, Wang said. "This is a fundamentally new technology that allows us to control electronic devices directly using mechanical agitation," Wang added. "This could be used in a broad range of areas, including robotics, MEMS, human-computer interfaces and other areas that involve mechanical deformation."

Mamma Mia! Bookie offers odds on ABBA reunion

LONDON (Reuters) - A British bookmaker is taking bets on an ABBA comeback after singer Agnetha Faltskog hinted at a possible reunion for Sweden's most successful band.

Faltskog, who has come out of retirement to release a solo album called "A", was asked by German's Die Zeit Magazine if she would be open to an ABBA reunion and she responded positively.

"Maybe a charity concert? I would not say 'No' right away," she said.

Her former husband Bjorn Ulvaeus and his fellow ABBA songwriter Benny Andersson vowed in 2008 not to reform the group that broke up in 1982 after nine British No.1 hits.

The fourth member of the group whose hits included "Mamma Mia", "Super Trouper", and "Dancing Queen", was Anni-Frid Lyngstad.

But speculation about ABBA reforming has mounted in the lead-up to the opening of a ABBA museum in Stockholm in May.

British bookmakers Paddy Power seized on the speculation to offer odds of 14/1 for ABBA to perform together in 2013.

The bookmaker was offering 16/1 on ABBA opening the 2013 Eurovision Song Contest in Malmo, Sweden, on May 16 as this was the show that propelled ABBA to fame following their 1974 win with the song "Waterloo".

"ABBA fans will be spitting out their meatballs in excitement at prospect of a reunion. Given home turf, plus the 40th anniversary of their Eurovision triumph, Paddy Power's 16/1 to open the show looks to be worth a pound of anybody's money," said a spokesman for the bookmaker.

NEW YORK (AP) ? NBC says it's planning a 12-day-long, around-the-clock competition show to air this fall.

The network said Wednesday that the trivia-based game show, "The Million Second Quiz," will air live in prime time from a specially built studio in the heart of Manhattan. This hourglass-shaped complex will also serve as the living quarters of the four finalists.

When the 12 days ? or 1 million seconds ? draw to a close, the winner could claim a cash prize of as much as $10 million.

Viewers will be able to play along in real time and sync to the prime-time broadcast.

NBC's president of alternative and late night programming calls the show "a game, a social experiment and a live interactive event."

The network didn't announce a premiere date.

Infosys openness backfires as missed guidance frustrates market

BANGALORE/MUMBAI (Reuters) - The openness that made Indian IT services outsourcer Infosys Ltd an investor darling has come back to haunt it.

For years, Infosys was an industry bellwether for not just giving revenue and earnings guidance but usually exceeding it, making it an outlier in a country where very few companies offer guidance and corporate transparency is often lacking.

But several times in the past two years, Infosys has missed its own forecasts, precipitating violent stock moves that culminated in a 21 percent plunge on the day of its most recent earnings report. This has prompted some in the market to question whether the company should keep giving guidance.

"Considering that the company is unable to meet guidance, the very act of giving guidance is becoming a reason for volatility," said Jagannadham Thunuguntla, head of research at brokerage SMC Global Securities in New Delhi.

Its latest results came with a new growth forecast that was below analyst expectations, and the one-day stock plunge was the biggest in a decade for Bangalore-based Infosys.

Only three months earlier, an unexpectedly strong December quarter sent its shares nearly 17 percent higher on the day and raised investor hopes for a turnaround. Growth at Infosys, the No.2 Indian player by revenue, has lagged rivals as it struggled to implement a strategic revamp amid difficult conditions for its clients in the United States and Europe.

"We think Infosys would have been better off not giving FY13 guidance than give one which lends itself to the worst possible interpretations," JP Morgan analyst Viju George, based in Mumbai, wrote shortly after Infosys' earnings report for the year that ended in March.

In July, Infosys slashed its full-year dollar revenue target and stopped giving quarterly revenue or earnings guidance.

For the fiscal year that started this month, Infosys forecast revenue growth of 6 to 10 percent in dollar terms, a wider range than the 1 to 2 percentage points it typically gives and less than the 12 percent growth expected by several analysts.

"By giving revenue guidance so wide so as to render it meaningless and by refusing to spell out a floor for FY14 margins and, particularly, by stating that it cannot predict margins in the near term for its business, management has played to the street's worst fears," George wrote.

GOLDEN SILENCE?

Infosys is not the only IT company to disappoint with its outlook. Shares in third-ranked Wipro Ltd lost 8 percent after its March quarter earnings met forecasts but its revenue guidance for the current quarter lagged market expectations.

Industry leader Tata Consultancy Services Ltd does not give specific guidance, but has said it expects its revenue will grow faster than the industry trade group's forecast this fiscal year.

Infosys and some analysts argue that the company has a hard time forecasting revenue because a significant chunk of corporate customer spending on its services is discretionary.

Chief Executive S. D. Shibulal told analysts after the latest earnings announcement that it had become harder to make quarterly predictions in a volatile environment. Still, he said, "the rationale for guidance is not changed."

Outside the IT sector, only a handful of Indian companies, including Ranbaxy Laboratories Ltd, the country's top drugmaker by sales, and leading construction and engineering company Larsen & Toubro Ltd give revenue guidance.

Several investors said Infosys should keep giving guidance.

"If they stop giving guidance and still deliver this type of numbers, then it will be even more negative," said Phani Sekhar, a fund manager at Angel Broking in Mumbai, which owns Infosys shares. "The best thing for them right now is to match up to whatever they have said."

A 6-year-old South Florida boy suffered minor injuries after being attacked by an alligator, federal wildlife officials said Monday.

The alligator attacked Friday afternoon when Joey?Welch?of Pompano Beach, north of Fort Lauderdale, fell into shallow water at the edge of a boat ramp in the Arthur R. Marshall Loxahatchee National Wildlife Refuge, according to the US Fish and Wildlife Service.

"I went in it and there was a splash. The alligator just swam into me and clamped my arm," the boy told WPLG-TV.

Joey's father and other bystanders punched and kicked the alligator until it released the child.

"I didn't want to play tug-of-war with the alligator and get his arm ripped off," Joseph?Welch?told WSVN-TV.

Joey was treated at a hospital for cuts and bruises to his right arm, shoulder and chest, wildlife officials said. His father had a bruised right hand from punching the alligator.

Doctors who treated the boy at Holy Cross Hospital were stunned his arm wasn't torn off and told WPLG-TV it was a miracle.?

The federal agency said trappers licensed by the Florida Fish and Wildlife Conservation Commission captured and killed the 8-foot-long alligator.

"We are extremely relieved the child made it out of this potentially deadly incident with only minor injuries," said Rolf Olson, an official at the wildlife refuge. "This really could have ended very badly. We thank the members of the public who saw this happening and selflessly rushed in to do the right thing."

Tart cherries linked to reduced risk of stroke

Apr. 23, 2013 ? For the millions of Americans at risk for heart disease or diabetes, a diet that includes tart cherries might actually be better than what the doctor ordered, according to new animal research from the University of Michigan Health System.

A class of drugs called PPAR agonists that help regulate fat and glucose was considered promising by doctors who prescribed them for patients with metabolic syndrome -- a collection of risk factors linked to heart disease and type 2. However, studies have shown the long-term use of these drugs can also increase stroke risk, which has prevented many from securing FDA approval.

The new research from the U-M Cardioprotection Research Laboratory suggests that tart cherries not only provide similar cardiovascular benefits as the prescribed medications, but can also reduce the risk of stroke, even when taken with these pharmaceutical options.

The results, which were seen in stroke-prone rats, were presented April 23 at the Experimental Biology 2013 meeting in Boston.

The group's previous research has shown that intake of U.S.-produced, Montmorency tart cherries activates PPAR isoforms (peroxisome proliferator activating receptors) in many of the body's tissues. Researchers believe that anthocyanins -- the pigments that give the fruit its red color -- may be responsible for PPAR activation.

PPARs regulate genes involved in fat and glucose metabolism, and when modified can help reduce the risk of cardiovascular disease. PPAR agonists, among them medications such as Actos (pioglitazone), act in a similar way but cardiovascular side effects have limited their use.

"Our previous research has shown that Montmorency tart cherries can have a positive effect on cardiovascular health and can reduce risk factors like high cholesterol and diabetes," says E. Mitchell Seymour, Ph.D., supervisor of the Cardioprotection Research Laboratory. "While prescribed drugs improve the outlook for certain risk factors, they've also shown to have undesirable side effects. We wanted to see if a tart cherry-rich diet might provide similar cardiovascular benefits without the risk of heart attack or stroke."

The researchers compared the effect of tart cherries and the drug Actos in stroke-prone rats by measuring the animals' systolic blood pressure as well as locomotion, balance, coordination, all of which can show the aftereffects of a stroke.

By putting the rats through various physical tests, such as walking on a tapered beam and climbing a ladder, the researchers found that compared to Actos, tart cherry intake significantly improved balance and coordination, and at the same time lowered blood pressure.

While the research results indicate that rats who consumed only tart cherries had the best results, those who had the combination of tart cherries and Actos also did better than those who only took the drug. Seymour cautioned that the results can't be applied directly to humans, but they are a potentially positive sign for those taking medications.

"We weren't sure if the risk for stroke would decline in animals taking both tart cherry and the drug," Seymour says. "It turns out that the cherries did have a positive effect even when combined with the medication."

Steven Bolling, M.D., a U-M cardiac surgeon and the laboratory's director, said the study adds to the group's growing body of research linking cherries to positive heart health. The results provide the groundwork for continued investigation into the topic, he says.

"This research is the first to link to cherries to a reduction in stroke-related symptoms," Bolling says. "It gives us a good preclinical model to further explore the positive stroke-related benefits of an anthocyanin-rich diet."

MEDFORD, Mass. (AP) ? Hundreds of family and friends packed a church in Medford, Mass., for the funeral of a Boston Marathon bombing victim, while dozens more waited outside after being turned away.

Gov. Deval Patrick and Cardinal Sean O'Malley were among the people who attended the funeral Mass Monday for 29-year-old Krystle Campbell at St. Joseph Church in her hometown.

Campbell was one of three people killed near the finish line a week ago. The restaurant manager had gone to watch a friend finish the race.

Marishi Charles, who attended the funeral, says Campbell's parents were too distraught to talk, so pastor Chip Hines spoke for them during the service, saying "Krystle was always there for people."

Co-worker Julia Dziamba could not get in. She says she remembers Campbell as "beautiful, fun and lovely."

Authorities on Sunday released the names of five backcountry snowboarders killed in a deadly Colorado avalanche a day earlier.

Killed in the slide near Loveland Pass, about 60 miles west of Denver, were Ian Lanphere, 36; Rick Gaukel, 33; Chris Peters, 31; Joe Timlin, 32; and Ryan Novack, 33, Denver NBC-affiliate KUSA reported. All of the men were Colorado residents.

A sixth member of the group was buried in the snow, but was able to dig himself out and call for help.

"If he hadn't gotten out, if he would've been buried too, it's hard telling when we might've found out," Clear Creek County Sheriff Don Krueger told KUSA.

Investigators said the snowboarders were hiking up a drainage area called Sheep Creek when they may have instigated the avalanche, which was about 650 feet wide, more than 1,000 feet long and eight feet deep.

"It appears that they triggered the avalanche low down on the slope much like?pulling a log out from the bottom of?a wood pile," Dale Atkins, a member of the area's Alpine Rescue Team, told KUSA.? "It caused the avalanche and quite a large one to crash down on top of them."

Saturday's avalanche was deadliest in Colorado since 1962, when seven people were killed near Twin Lakes, KUSA said. The area where the slide occurred Saturday has received nearly four feet of new snow in recent days.

CSIRO and Mirus Bio LLC are pleased to announce a new license arrangement that will enable Mirus Bio to utilize the unique characteristics of CSIRO's Reversible Addition-Fragmentation chain Transfer polymerisation technology (RAFT) to expand upon its high-end polymer development capabilities for the biotech industry.

Mirus Bio Vice President of Scientific Operations Scott Hayes said the agreement would allow the company to broaden its expertise.

"This agreement with CSIRO broadens the scope of specialised polymer design tools available to Mirus and facilitates our continued efforts to improve nucleic acid transfer capabilities. We expect that utilization of RAFT will lead to new discoveries and expedite our product development efforts," Dr Hayes said.

"CSIRO is very pleased to be working with Mirus Bio in the transfection space," said Cathy Foley from CSIRO.

"The scientists at Mirus are leaders in introducing innovative products in this area and have developed a range of delivery technologies for researchers in the biotech industry that can make use of our polymer technology," she said.

"RAFT has very broad applicability in the biotech and biomedical industry because of the need for new and improved multifunctional polymers for many different applications. RAFT enables the rapid, rational design and prove-out of bespoke macromolecules," Dr Foley said.
